Rhetorik-Grundkurs, Erste Lektion: Immer mit einem Witz beginnen. Aus dem Archiv: Hallo Sonntag, 14.08.2011. Einer geht noch: Was haben Studenten und Walfische gemeinsam? Immer im Tran und die meiste Kraft im Schwanz. Ok, der war ein bisschen Walfischfeindlich, aber ganz putzig.
Die Überleitung ist es jetzt etwas ruckelig, zum Bundesverfassungsgericht BVG, aus dem Eintrag vom 29.10.23 . Geht mir irgendwie nicht aus dem Kopf, was vermutlich auch an der Sogkraft des Bildes von Maina-Miriam Munski in dem Eintrag liegt.
Da ging es um die Tatsache, dass dieses famose Organ BVG noch 1966 dekretiert hatte, dass die Ehefrau im Akte der ehelichen (!) Beiwohnung weder Gleichgültigkeit noch Widerwillen zur Schau stellen dürfe. 1997, richtig gelesen, nicht 1897, beschloss der Bundestag, Vergewaltigung in der Ehe als Verbrechen ins StGB zu übernehmen. Im Umkehrschluss: Bis dahin konnte der Ehemann die Göttergattin halbtot zum Verkehr prügeln und blieb straffrei. Zu den 138 Abgeordneten, die auch noch 1997 dagegen stimmten, gehörte Friedrich Merz . Ich erwähne das deshalb, weil es mir beim Umgang mit Faschismus nicht nur um die politisch organisierte Herrschaftsform geht, sondern auch um psychische Strukturen und Mentalitäten. Der Faschismus als Herrschaftsform kann nur da an die Macht gelangen, wo er auf eine entsprechende psychische Disposition einer hohen Anzahl von Mitgliedern der Gesellschaft trifft. Als da unter anderem wären: Analer Zwangscharakter , Unfähigkeit zu Empathie, sadistische Tendenzen, autoritärer Charakter, ausgeprägtes Wut- und Hasspotential, Frauenverachtung, Starrheit, Mangel an Selbstreflexion etc. pp. Da kommt am Ende nicht zwangsläufig unser kleiner Faschist bei raus, so wie Merz eher ein hemmungsloser Opportunist im Sinne des Diederich Heßling ist, aber die Disposition dazu ist bei einer Häufung von solchen Merkmalen wahrscheinlicher als bei einem eher libertären Charakter.
Merz und andere, schlimmere, Konsorten wie Höcke, stehen in Traditionslinien, verkörpern Kontinuitäten. Die deutsche Justiz wurde nach 1945 komplett nicht entnazifiziert, die gleichen Henker und Verbrecher urteilten, bis in höchste Instanzen, nach 1945 ungebrochen weiter, im Zweifel wieder gegen Opfer des Faschismus. Wie der furchtbare Nazirichter Willi Geiger, der am BVG-Beiwohnungsurteil von 1966 beteiligt war. Offensichtlich wirkte dieser klerikal-faschistische Geist des patriarchalen Durchgriffs auf den weiblichen Körper noch bis 1997, siehe Merz. Und darüber hinaus. Und wirkt, und wirkt …. .
Wie krank die BVG-Dekretierung von 1966 ist, wird klar, wenn man (!) sich das Geschehen in der ehelichen Kemenate konkret vor Augen führt: Es kommt also zur Scheidungsklage, weil die Gemahlin während des Aktes Gleichgültigkeit bis hin zum Widerwillen an den Tag legte. Wie wurde da eigentlich der eherne Rechtsgrundsatz gehandhabt: Bei Aussage gegen Aussage in dubio pro reo? Oder hatte der Gemahl den Nachbarn dazu gebeten, zwecks Protokoll? Video, Handys etc. gab es damals ja nicht.
Widerwillen wäre ja für unseren sensiblen Ehegatten-Wahrnehmungs-Weltmeister noch zu realisieren, wenn sich die Gattin z. B. während des Aktes übergibt. Klare Willensäußerung. Aber Gleichgültigkeit? Ist da schon das einfache Fehlen von Begeisterungsbekundungen wie z. B.: „Oh ja, mach mir den Hengst, du geiler Fickfrosch?“ (Ich bitte, mir diese Verbalentgleisung nachzusehen, ich möchte halt nur anschaulich sein.) Oder muss es schon aktives Tun sein, wie die Lektüre eines Buches während des coitalen Geschehens? Was technisch in der a tergo-Position machbar ist, siehe auch TV-Konsum. Zigarette rauchen dabei wäre auch ein deutliches Indiz. Ich zitiere mal sinngemäß aus einem Urteil von 1965: „Der Klage auf Scheidung wegen übergroßer Gleichgültigkeit im ehelichen Gemach wurde stattgegeben, weil der Kläger glaubhaft machen konnte, dass er die Beklagte mit Gewalt dazu zwingen musste (durfte er bis 1997, d. A.), die Zigarette aus dem Mund zu nehmen, damit sie ihn im Akte der Beiwohnung felliert.“
„Sie felliert“ ist 3. Person Singular, weiblich, Präsens, Indikativ, von „fellieren“, dem Verb zu Fellatio. („Er felliert“ geht selbstverständlich auch, bei „Es felliert“ wird’s schon schwierig bis schwerkriminell.) Auch wenn jetzt einige ins Schlucken kommen, ob der grammatischen Verrenkungen: Cunnilingieren gibt es natürlich auch. Wer erinnert sich nicht an den Asterixband mit dem römischen Centurio Gaius Julius Cunnilingus und seine Abenteuer mit der gallischen Konkubine Fellatrix.
